New York – New York (AP) – Harvey Weinstein ‘The #Metoo trial next month will be largely a summary version of the original, with a great addition: a position based on an accusation of a woman who was not part of the first case.
The way in which the repetition of the prosecution of the Mogul of films in disgrace must focus on Wednesday, when a judge will issue decisions about a variety of issues, including the scope of the testimony of accusers and possible expert witnesses.
Weinstein, 72, is expected to be in court when Judge Curtis Farber governs.
His new trial will begin on April 15 at the State Court in Manhattan, almost a year after the highest court in New York Vorred his 2020 sentence for rape and positions of sexual assault.
In his last appearance in the Court, in January, Weinstein implored Farber to begin the new trial before. He told the judge “I don’t know how much more I can endure” with cancer, heart problems and hard conditions in the Rikers Island prison complex in New York City, where he is locked up.
Weinstein is being withdrawn by the positions that oral sex made in a films and television production assistant in 2006 and violated an aspiring actor in 2013. The additional position, presented last September, alleges that he forced oral sex in a different woman in a Manhattan hotel in 2006.
The Manhattan District Prosecutor’s Office, Alvin Bragg, said in the judicial documents that the woman, that she has not been publicly identified, was presented to prosecutors a few days before the beginning of Weinstein’s first trial, but was not part of that case.
The prosecutors said they did not pursue the accusations of the women after Weinstein was sentenced and sentenced to 23 years in prison, but they reviewed and obtained a new accusation after the State Appeals Court threw his sentence last April.
Farber ruled in October to combine the new accusation and the charges existing in a single trial.
Weinstein’s lawyers argue that prosecutors harmed him when waiting for almost five years to present the additional position, suggesting that they had chosen not to include the accusation in their first judgment to be able to use it later if their conviction was reversed.
Weinstein has denied that he raped or sexually assaulted anyone.
Last month, Weinstein added to Jennifer Bonjean, a lawyer who has represented Bill Cosby and R. Kelly, a legal team that includes defense lawyers Arthur Aidala, Diana Fabi Samson and former judge Barry Kamins.
In Decompating Weinstein’s condemnationThe Court of Appeals ruled that the judge of first instance, James M. Burke, unfairly allowed the testimony against him based on the accusations of other women who were not part of the case. Burke is no longer in the bank and such testimony will not be part of the trial.
Weinstein was condemned in Los Angeles In 2022 of another violation. His 16 -year prison sentence in that case is still standing, but his lawyers appealed in Junearguing that he did not receive a fair trial.
