The 2 -year -old American citizen family who was deported with his mother to Honduras last month, voluntarily dismissed his demand against the Trump administration, one of the lawyers who represents the family told ABC News.
“Given the traumatizing experiences through which families have passed, they are step back to have complete discussions about all their options, the safety and well -being of their children, and the best ways of proceeding so that the damages they have suffered can be addressed completely,” said lawyer Gracie Willis.

“They are voluntarily rejecting this case to give space and time to consider all the options that are available to them,” he added.
Last month, a federal judge said he had a strong suspicion that the Trump administration deported a 2 -year -old American citizen to Honduras “without a significant process.”

The American citizen, identified in the presentations as “VML”, was initially arrested with his mother and sister, who lacked legal status to be in the United States, in a routine immigration record in New Orleans last month. After the 2 -year -old father learned that his family was arrested, his lawyer called immigration officials to inform them that VML is a US citizen and could not be deported, according to judicial documents.
Before the Court responded to the request of Habeas and a motion for a temporary restriction order, the 2 -year -old girl, together with her mother and sister, were deported to Honduras, according to judicial documents.
In response to the motion, the lawyers of the Department of Justice said it was the best for the child that she remains in legal custody of her mother and that she was not at an “irreparable risk because he is an American citizen.”
The American District Judge Terry Doughty had scheduled a hearing in the case of May 16.
“ACLU withdrew its lawsuit on false statements that DHS deported an American citizen,” the deputy secretary Tricia McLaughlin said on Saturday in a statement.

“The truth is, and it has always been, that the mother, who was in the country illegally, chose to bring her 2 -year -old son with her when she was eliminated. The narration that DHS sports to US children is false and irresponsible,” he added.
